Explaining joint legal custody of a child

In many child custody cases, the court will award joint legal custody even when one parent has physical custody and the other has visitation rights. Why? The court would rather have both parents make the important life decisions for their child together than have one parent make all of the decisions. We will explain joint legal custody of a child in today's post.

When joint legal custody is issued, the parents must be make the following decisions for their child together:

  • How the child will be raised and where
  • Where the child will go to school
  • How the child will be cared for medically
  • The religious upbringing of the child
  • The extracurricular activities the child will take part in outside of school

The parents must have open lines of communication with each other in order for joint legal custody to work. If you have trouble speaking to the other parent, you need to put your differences aside for your child. You also cannot make important decisions without the input of the other parent. This includes changing your child's school, which religion they will be baptized in, which doctor they will see and which medical treatment they will undergo.

Joint legal custody can be awarded in situations where joint physical custody is awarded and where sole physical custody is awarded. The court prefers having both parents involved in the decisions of the child's upbringing.

As you can see, joint legal custody is very important in today's world. You will need to put your differences aside so that you make decisions together in the best interest of your child. You can always get the family court involved if the other parent is not following the child custody agreement.
