Fatal Wisconsin crash leads to OWI arrest

On Oct. 13, a man caused a serious crash while driving his vehicle in Walworth County. Police said that he was traveling on Highway 89 in Whitewater when the fatal accident occurred.

Police said that the incident happened close to Island Road as woman driving an SUV on Highway 89 decreased her speed to make a turn into a driveway. The man, driving behind her, failed to slow down in time, authorities say, and he rear-ended her with enough force to cause the SUV to flip over, leave the roadway and eventually come to a halt in a gully.

The accident also caused the 40-year-old driver of the SUV to be thrown out of her vehicle; she died at the scene. Emergency responders reportedly transported a young passenger from the SUV to the hospital for the treatment of moderate injuries; reports did not say how she was related to the older woman. After the collision, the 50-year-old motorist was detained, and police said that he could face multiple charges, including homicide OWI, causing injury via OWI and reckless driving.

If the young passenger in this case was a dependant of the victim, she may have to deal with more than her physical injuries and grief. In some cases, a wrongful death claim filed against a person who negligently or recklessly caused the death of another person can seek compensation for lost earning potential in addition to final expenses. An injured person could alternatively pursue a personal injury claim to seek compensation for his or her medical expenses. In a case like this, a personal injury attorney could completed investigation reports from police, witness reports or other such evidence to pursue a claim against the reckless or negligent driver who was responsible.
